According to the provisions of Article 10, Paragraph 18 of the Copyright Law: The copyright owner may transfer all or part of items (5) to Clause 1 of this Article. (17), and receive remuneration in accordance with the agreement or relevant provisions of this Law. It can be seen from this that as long as both parties do not violate the mandatory provisions of the Civil Code, Copyright Law and relevant laws, the transfer is allowed.
Transfer of copyright and its process
1. Process
The applicant submits registration application materials → the registration agency verifies the received materials → notifies payment → the applicant pays the registration fee → the registration agency accepts the application → examines → produces and issues a registration certificate → announcement.
2. Required materials
Materials and requirements that should be submitted when applying for copyright contract filing:
(1) Copyright contract registration application form;
(2) Applicant’s identity certificate;
(3) Copyright transfer or licensing contract or agreement applied for filing;
(4) Contract Samples of works involved in the application;
(5) When entrusting another person to apply on your behalf, the agent should submit a letter of authorization from the applicant;
(6) Proof of identity of the agent;
(7) Materials proving the ownership of copyright and related rights.
3. Processing time
The registration application will be processed within 30 working days after the registration agency accepts it. If supplements and corrections are required, the applicant shall complete the supplements and corrections within 60 days after receiving the notice of supplements and corrections, and the registration agency shall complete the process within 30 working days after receiving the supplements and corrections that meet the requirements.
