How to register Intellectual property rights Apply
Intellectual property right holders may apply for recordation of their intellectual property rights to the General Administration of Customs in accordance with the provisions of the Customs Protection Regulations on Intellectual Property Rights; if applying for recordation, an application form shall be submitted. The application should include the following content:
(1) The name, registration place or nationality of the intellectual property rights holder;
(2) Name, content and related information of intellectual property;
(3) Intellectual property licensing exercise status ;(4) Legal exercise by intellectual property rights holders The name, place of origin, entry and exit customs, importers and exporters, main characteristics, price, etc. of goods with intellectual property rights;(5) Manufacturers, importers and exporters of goods that are known to infringe intellectual property rights, customs at the place of entry and exit, main characteristics, and prices wait.
If the application content specified in the preceding paragraph has supporting documents, the intellectual property rights holder shall attach the supporting documents.
The General Administration of Customs shall make a decision on whether to approve the filing within 30 working days from the date of receipt of all application documents, and notify the applicant in writing; if the filing is not approved, the reasons shall be stated.
Case in which customs refuses to register
If any of the following circumstances occur, the General Administration of Customs will not file the record:
(1) Application documents are incomplete or invalid;
(2) The applicant is not the intellectual property right owner;
(3) Intellectual property rights are no longer protected by laws and administrative regulations.
If the customs finds that the intellectual property rights holder has failed to truthfully provide relevant information or documents when applying for intellectual property registration, the General Administration of Customs may revoke the registration.
