The personal rights and property rights of the copyright owner constitute the contents of the copyright. It refers to the copyright owner’s legal rights to the work and the obligations borne by others.
(1) Personal rights of copyright; Personal rights of copyright are the moral rights that the author enjoys in accordance with the law in the work. It is different from the personal rights in civil law. The personal rights in copyright include Author's right to identity. The personal rights enjoyed by the author only arise after the creation of the work. They are enjoyed by the author for life and are generally intransferable and inalienable. Property rights in copyrights are transferable, but personal rights are generally not transferable. According to the laws of our country, personal rights of copyright mainly include:
1) Right of publication.
2) Right of signature.
3) Right to modify.
4) Protect the integrity of the work.
(2) Copyright property rights;
Copyright property rights refer to the copyright owner or authorizing others to use the work and the right to receive remuneration. my country's Copyright Law stipulates that copyright holders have the right to use and receive remuneration, that is, the right to use works by copying, performing, broadcasting, exhibiting, distributing, making movies, television, videos, or adapting, translating, annotating, editing, etc.; and the right to license others to use the work in the above-mentioned manner and receive compensation for doing so. Unless otherwise provided by law or administrative regulations, in general, any use of the work must be authorized by the author and remuneration must be paid.
